Terms & Conditions

The subsequent terms and conditions apply to the servicing and repair of motor vehicles executed by AUTO BADY REPAIR 1 Ltd, referred to as "the Garage" henceforth.

Glossary:

  • "The Garage": AUTO BODY REPAIR 1LTD, Located at 4 Peartree Farm, Welwyn Garden City AL7 3UW

  • "The Customer": Anyone, be it an individual, company, or organization, seeking services from the Garage.

  • “Work”: All services offered by the Garage such as repairs, paintwork and detailing.

  • “Price”: The total fee for the Work, encompassing parts, labor, VAT, and other potential charges.

  • “Vehicle”: Pertains to the motor vehicle belonging to the Customer which can vary from cars, motorcycles, vans, motorhomes, to caravans and trailers.

By scheduling any Work, an agreement based on these terms is established between the Garage and the Customer.

Customers who request work via phone or online confirm that they are legally able to form contracts, are at least 18 years old, and reside in the UK.

THE WORK

  • We aim to provide a precise timeframe for the Work. If unforeseen challenges like unavailability of parts arise, we'll promptly inform you.

  • If there's a delay, customers can opt to cancel, in alignment with clause 10.

  • Before starting, we'll detail the cost of proposed Work, which both parties must approve.

  • If additional parts or labor are needed midway, we'll first obtain the Customer's consent after providing a new estimate.

  • Handing over your vehicle keys and scheduling the Work signifies acceptance of the cost and these terms.

  • Specific components like special oils or unique spark plugs used during service might come at extra costs, of which we'll notify you.

  • All parts used will be new and either from the original equipment manufacturer or of comparable quality. Any deviations will be communicated and your explicit consent will be sought.

  • Replaced parts can be shown to customers upon collection. If the customer wishes to take them, a fee might be imposed, refundable upon their return. If not, we'll handle the disposal.

  • We're dedicated to caring for your vehicle and any items inside. However, we're not liable for loss or damage to such items. We advise removing valuable items before the Work commences.

PAYMENT

  • We hold a lien on the Vehicle and its contents from the start of Work until all due amounts are settled.

  • An invoice will be provided upon Work completion, payable through cash, bank transfer, or card.

  • Payment is expected immediately upon invoice receipt.

  • The vehicle will be returned once full payment is cleared.

  • Invoices will detail all Work, parts, labor, and the associated Price.

  • All prices, including for additional Work, contain VAT.

  • Special order parts must be prepaid and are non-refundable. A 30% handling charge may apply, and customers will be notified beforehand.

  • In the event of unpaid invoices post 30 days of notice, we reserve the right to sell the Vehicle to recoup costs.

  • Outstanding payments after the due date accrue daily interest at 2% above the Bank of England's base rate until settled.

  • We expect Vehicles to be collected within a day of completion notification. Delayed pickups might lead to a £20/day storage fee, excluding VAT, unless a written agreement states otherwise.

    WARRANTY
    Beyond statutory rights, we offer a 12-month/12,000-mile warranty for parts we replace and associated workmanship. Some products might not be under this warranty; we'll tell you during the work booking. The warranty is valid if:

    • We can inspect and fix any issues in a timely manner.

    • You follow the vehicle's operating guidelines.

    • The vehicle is maintained per the manufacturer's schedule using approved parts and by a VAT-registered garage.

    • Our advice and instructions are followed.

    • The parts and work are not exposed to excessive wear or misuse.

    • Some warranties might differ based on the original manufacturer’s conditions; you'll be informed.

    • The warranty is tied to the vehicle and transfers with ownership.

    CUSTOMER-PROVIDED PARTS
    We don't cover parts you provide. If they damage the vehicle, you'll be billed for any associated costs.

    EXISTING WARRANTIES
    If your vehicle is under manufacturer's warranties when we work on it, we'll comply with those terms. You'll be informed about any additional costs due to compliance and related implications. We'll get permission from the warranty provider before starting work, and it's your duty to tell us about any existing warranties.

    INSURANCE CLAIMS
    For work under insurance claims, the policyholder might need to sign insurer documents. Delays caused by insurers are not our responsibility.

    CANCELLATION
    You can cancel anytime. Costs for work already done will be billed, and pre-paid parts are non-refundable.

    LIABILITIES
    We have insurance, including public liability. Our liability is limited to our insurance coverage. You're responsible if you don't follow our or the manufacturer's advice. We aren't liable for storage-related issues. We'll cover damages due to our work. Both parties cover their own liabilities.

    SUB-CONTRACTING
    We can sub-contract tasks if no extra costs are passed onto you without consent.

    COMPLAINTS
    Report complaints in writing within 28 days. We'll investigate and aim to resolve issues within 25 days of receiving the complaint.

    CONSUMER RIGHTS
    Your statutory rights are unaffected.

    ABUSE
    We won't tolerate abuse. Abusers will be removed, and we'll involve the police if needed.

    DATA PROTECTION
    We store your data for marketing. You can opt out. We won't share data without your consent, except in specific circumstances, such as legal requirements.

    MISC

    • No failure to enforce these terms means a waiver of rights.

    • Invalid provisions don't nullify the entire agreement.

    • Neither party is liable for uncontrollable events affecting their obligations.

    • These terms follow England and Wales law, and related disputes fall under their jurisdiction.
